Display of Banners in the City of Hamilton

TERMS AND CONDITIONS (1.13.10)

  1. Banners may not be displayed anywhere within the City of Hamilton limits except with the approval in writing of the Corporation of Hamilton.
  2. Banners may be approved for the purpose of promoting major international events that clearly attract visitors to the Island and would, in the opinion of the Corporation, help to promote the City, e.g. international sports events, Bermuda International Film Festival, Bermuda Music Festival, etc. Consideration may also be given to banners for local events that are of interest to visitors and to the community at large, e.g. Harbour Nights, Annual Exhibition, etc.
  3. Approval may be granted for banners to be hung on designated street light poles in various locations around the City (see attached map), and above the entrance to City Hall (only to promote events taking place in City Hall). In exceptional circumstances, banners may be hung across Front Street, e.g. for the Invitational Race Weekend. Applications to erect banners in other locations are unlikely to be approved.
  4. Banners must be completely non-commercial in nature, and must focus on identifying the event. The title of events that include a sponsor’s name, e.g. KPMG Invitational Race Weekend, or Colourcraft Gold Cup Races, may be considered for approval, but no other commercial text will be approved, e.g. nothing that says “…sponsored by….” for example. The font spelling out the sponsor’s name must be smaller in proportion to the rest of the banner design.
  5. The attached application for the display of banners must be completed in the first instance. All applications will be considered by the Corporation for approval, and each application will be considered on its own merits, and not as a matter of precedence, except that, given the increasing popularity of banners, the Corporation will approve banners that promote events within the City, before considering banner applications for events outside of the City.
  6. Applications should be submitted a minimum of six weeks prior to the event, in order to ensure that the approval process is completed in time to have the approved banners manufactured prior to the event. In the case of events that occur on a regular annual basis, a new application must be submitted each year.
  7. Each application must be accompanied by a sketch or artist’s impression of the proposed banner, together with an indication of colours to be used. Banners should be of simple design, bold and bright, with a minimum of lettering, in order to maximize visibility and impact on the passers-by. White or other pale colours tend to get lost in the background. The Corporation reserves the right to reject unsuitable formats, especially those that are perceived to be too commercial in nature.
  8. The attached Letter of Agreement must be signed by the organizing body, and the fee to erect the banners paid as soon as approval has been granted. Failure to do so may result in the banners not being erected in time for the start of the event.
  9. Banners will be hung and removed only by the Corporation of Hamilton, on Sunday mornings when traffic disruption will be minimized.
  10. The fee charged to hang and remove banners is $500. The fee is purely a recoverable cost, and no profit is realized by the Corporation.
  11. The cost of designing and manufacturing the banners will be met entirely by the organizers.

  13. Banners are typically designed in pairs: either matching pairs, or complementing pairs that constitute two parts of a whole. In the latter case, it is important to note which side of the pole each banner is hung from. It is also important that banners are printed back and front, so they look the same from any direction. A single banner on a light pole is not as effective as a pair of banners on each pole.
  14. The dimensions of banners for the street light poles are normally 24” by 60”, but can go up to 72” if necessary. Banners require loops at the top and bottom. The bottom loops or holes must be a minimum of 2 ½” in diameter.
  15. The dimensions of banners intended for the front of City Hall can be as large as 84” wide and 108” deep (7’ x 9’). These banners need about a 5” rollover at the top and bottom to run the pole through. The poles are spring poles that are adjustable, so there is some leeway regarding the size of the banner.
  16. Banners should be made of durable material that is resistant to rain, wind, and tension. Designs and text must be colourfast.
  17. There are 48 street light poles throughout the City with banner fittings that carry a total of 96 banners (see attached map). While the majority of poles are along Front Street, there are also locations at the City entrances (Par-la-Ville Road, Cedar Avenue, Court Street and Reid Street East). The Corporation reserves the right to approve banners for two or more separate events occurring at the same, or overlapping times. While the Corporation will attempt, within reason, to accommodation specific location requests, it will be necessary on many occasions either to hang different banners on alternate poles, or to hang banners elsewhere than on Front Street. The Corporation reserves the right to make that decision based on the number of different banners to be hung at any one time. Whatever is decided, the banner applicant will be advised in advance. Banners have become an extremely popular form of promotion and the banner pole locations are all on mainstream City streets.
  18. The Corporation of Hamilton does not store banners from year to year. In the case of once-a-year events, the banners must be delivered by the organizer to the Corporation Yard on Dundonald Street by no later than 12:00 noon on the Friday before they are to be hung. The banners must be collected from the Corporation Yard within 24 hours after they have been taken down. In some cases, e.g. Harbour Nights, the informational signs and signs on barriers, must be delivered to, and collected from, the Corporation every week.
  19. The Corporation of Hamilton is not responsible for the condition of banners before they are put in place, while they are hanging, and after they have been removed. It should be noted that banners that are hanging might be stolen, damaged by storms, or damaged or defaced by vandals, none of which are factors over which the Corporation has any control. Nor is the Corporation responsible for banners that go missing. It is the responsibility of the organizer to keep track of their own banners, and to retrieve them from the Yard as quickly as possible after dismantling. Banners that have not been collected within one week after being taken down may be disposed of.

Banner Agreement

I, the undersigned, do hereby agree to the following terms and conditions for having our banners hung in the City of Hamilton.

  1. I have read, understood, and agree to comply with, the document entitled “Display of Banners in City of Hamilton – Terms and Conditions”.
  2. I understand that the hanging of banners is conditional upon (a) written approval of the Corporation of Hamilton, (b) the signing of this Agreement, and (c) payment in full of the banner fee of $500.
  3. I accept that banners for more than one event may be hung at the same or overlapping, times and specific placement requests are not guaranteed.
  4. I understand that the Corporation of Hamilton does not store banners between events, and that I am responsible for delivering the banners to the Corporation before the event and collecting them after the event. Banners left at the Corporation Yard for more than seven days after having been taken down, may be disposed of.
  5. I understand that the Corporation is not liable for damage to, or loss of, banners while they are in the Corporation’s possession, or hanging in public, except where the Corporation can be proved without doubt to be at fault. Damage to banners while hanging or the disappearance of banners while in public view are both beyond the control of the Corporation.
